Terms for paid services
In making any payment(s) to or by accepting any Statement(s) of Work from Easy A11y Guide, you agree that you have read, understood, and agreed to be bound by these Terms of Service in their entirety.
- Website owners are exclusively responsible for maintaining appropriate privacy policies & terms of service. Easy A11y Guide will assist you in getting set up with Termageddon which provides policies if you opt into this service.
- Plans are designed for small to medium business websites. Websites with additional features or utilizing resources outside of those for a standard small business will require custom plans with pricing to be determined.
- Websites owners are responsible for maintaining email hosting & domain registration.
- Billing notices will be sent 1-2 weeks prior to the due date for subscription services. The due date is the first day of the billing period in which maintenance is to be performed.
- If payment is not received by the due date, maintenance will NOT be performed until the bill is paid. By signing this agreement you agree to make payments on time & understand plans are non-refundable.
- Termination of maintenance can be requested by email. Either party may terminate the maintenance agreement. The currently paid maintenance will be performed until the end of the payment period unless earlier termination is requested by the client.
- Speed testing & tweaks (if you have signed up for them) only guarantees that your site will receive regular testing & tweaks. It does not guarantee any specific speed results.
- Maintenance plans may include a number of subscription services, plugins, or themes that are paid for by Easy A11y Guide. Upon termination of maintenance, you will lose access to those subscriptions.
- Included are updates to WordPress core, themes, and plugins. If a license is required for the theme or plugin updates and it’s not in the Premium plugins we include, then you will be responsible for paying for any needed license fees.
- For maintenance plans, if the theme or plugins have changes that require less than 15 minutes of work to your site to implement the changes needed to go with the update, that is included. Any additional time will be billed as development time. Also not included are if a plugin or theme you are using is no longer supported and needs replacement.
- Additional development time besides what is included in your plan is billed at the hourly rate of $160/hr and sent as a separate invoice at the end of the month. Failure to pay this invoice within 30 days will result in the termination of maintenance.
- If you require priority development work and/or on-call availability (8am-10pm ET), it is $80/day. Requests for on-call work must be at least 3 business days in advance and are subject to approval by Easy A11y Guide.
- Pricing is subject to change. Prior to any pricing changes, you will receive a notice and the option to terminate your service prior to the price change. The standard notice period is 90 days.
- We require independent access (does not require any confirmation codes to go through you) to your hosting & WordPress. If there are any changes to your hosting or the username / password which you have provided us for login, you agree to inform us immediately. We can not perform work on sites that we can not access. You also agree to provide us with up-to-date contact information including your name, phone number, and email address.
- Independent access to your registrar & DNS on Cloudflare with delegate access to us is required for hosting clients but not for maintenance. If you do not provide independent access, then you accept all responsibility for downtime and errors related to those services.
- We will install and maintain security measures, but we can not guarantee the security of your site. Hacker groups have taken down major media sites, government sites, as well as many other sites. No website can be guaranteed 100% hacker-proof. In the event of a hack, we will work with your hosting company to resolve the issue, but it may take time to resolve. Time to resolve hack will be billed as development time.
- Web accessibility will be measured against WCAG (Web Content Accessibility Guidelines). Due to the rapidly changing legal landscape, we can not guarantee that conforming with WCAG equates to compliance with the Americans with Disabilities Act (ADA), Section 508, or any other applicable Laws. Not withstanding the foregoing and absent more concrete regulatory guidance in the future, we believe that WCAG is the best accessibility standard for most organizations to adhere to.
- As the website owner, you are fully and solely responsible for the content of your website and any legal claims against your site. We may provide information on generally accepted practices and/or articles regarding concerns for websites, but we are not a law firm and can not give you any legal advice.
- By signing up for a maintenance plan you understand these terms and will not hold Easy A11y Guide, any its assigns, employees, owners, or other stakeholders liable for your website or any legal claims brought against you or your website.
Agreement For Professional Services
Scope of Professional Services
Client contracts to receive, and Company contracts to provide Professional Services, including Website Accessibility Consulting and Remediation Services, Website Accessibility Monitoring and Maintenance Services, Website Design and Development Services, or other Services as described in any Statement of Work agreed to by both Parties during the term of this Agreement.
Each Statement of Work may include such additional terms and conditions as the Parties may wish to include. In the event of a conflict between the terms of this Agreement and a Statement of Work, the terms of this Agreement shall govern, unless the applicable Statement of Work specifically states that such provision shall govern. Each Statement of Work agreed to by the Parties shall attach to and become a part of this Agreement.
Phased Services
Services delivered as phased services are handled one phase at a time. Each phase has a specific deliverable or set of deliverables. A phase is 1-3 weeks of work for an agreed scope and budget. Phases must be funded prior to work beginning. At the end of each phase the next phase is scoped and that work is not locked into the next phase is funded by the client. Once the phase is agreed upon, the invoice will be sent to the client. The client has 7 calendar days to pay the invoice. If it is not paid within that time, Easy A11y Guide has the right to terminate the phase.
Development of Deliverables
For phased services, the client agrees to provide all agreed upon necessary information within the time described in the phase. Any delay by the client will result in the phase timeline being delayed. If the client is more than 7 calendar days delayed in delivering necessary information, there will be a $300 rescheduling fee that the client must pay to resume the phase.
The company has the right to terminate the agreement if the client is delayed more than 30 calendar days in delivering agreed upon necessary information.
Client Testing & Acceptance
The client has 7 calendar days to test and accept deliverables from a phase. If the client does not report any issues with the deliverables within 7 days in writing, then the deliverables are considered accepted. Testing and correction of any issues is limited to the scope of the phase.
Monthly Fixed Price Services
The month fixed price service is a time limited service and as such does not guarantee specific deliverables beyond a monthly report of what was accomplished in the month.
Hours of Operation
Easy A11y Guide operates Monday to Friday 9am to 5pm US ET, and observes US federal holidays. Clients may make requests for support outside of those times, and it will be handled on a case by case basis.
Requests from clients are normally responded to within 2 business days. For urgent issues, such as security items, that is normally handled same day.
For clients on hosting and maintenance plans, servers and sites are monitored 24/7 by a support team.
